Ukraine provides foreign citizens with the opportunity to be officially employed in its territory. To do so, an employer must obtain an Employment Permit for a Foreigner or Stateless Person.

Employment Permit for Foreigners is necessary for the following categories of people (grounds for obtaining a Permit):

1. Foreign hired workers: persons who have entered into an Employment Agreement (Contract) with a Ukrainian employer.
2. Seconded foreign employees: Employees sent by a foreign employer to Ukraine to perform a certain amount of work or provide services on the basis of a Foreign Economic Agreement.
3. Intra-corporate transferees: Foreign employees who work for a foreign business entity and are transferred to work in its representative office or branch in Ukraine.
4. Foreigners – owners of Ukrainian companies.

List of required documents:

To obtain the Permit, the employer must submit the following documents to the relevant regional Employment Centre:

1. Standard application form.
2. Copy of the foreigner's passport pages with personal data and a duly certified translation into Ukrainian.
3. Colour photograph measuring 3.5 x 4.5 cm.
4. Draft Employment Agreement (Contract) with a foreigner, certified by the employer.
5. Receipt for payment of taxes for issuing the Permit.

Additional documents may be required depending on the category:

• For seconded employees: A copy of the Foreign Economic Agreement and a document confirming the employment relationship with the foreign employer.
• For intra-corporate assignees: a copy of the foreign business entity's decision on the transfer and a copy of the Employment Agreement with the Ukrainian business entity.

Procedure for obtaining a Permit:

1. Preparing the documents: The employer collects a set of required documents.
2. Then, the taxes and official fees for issuing a Work Permit are paid.
3. Submitting an application: Documents are submitted to the regional Employment Centre by the employer in person or through an authorised person.
4. Consideration of the application: The Employment Centre considers the submitted documents and makes a decision within 7 business days.
5. Obtaining a Permit: If the decision is positive, the employer receives the Employment Permit for Foreigners.
